The options

Initially we want to understand what you would like to achieve, asses the financial pressure you are under and work out the total your business owes. 

This helps us to decide which insolvency option is right for you. Dependant on your circumstances, it may be the simplest option is to close and liquidate. In some cases it maybe to try and keep the business going by administration or a Company Voluntary Arrangement.

Here are the most common options:

  1. Liquidate and close. This takes approximately two weeks.
  2. Liquidate and buy back some of the company assets (at market value) to run a new reduced business.
  3. Administration or a pre-pack administration and sale.
  4. A Company Voluntary Arrangement.
  5. Being granted a time to pay arrangement with HMRC and other creditors and keep going.
Other helpful Insolvency advice worth knowing

In some cases, ‘rescue’ of the business may mean closing by liquidation and you buying back the assets and starting again. In these circumstances the assets have to be independently valued and you may need to use a Section 216 Insolvency Act procedure to keep the business name.

It is worth noting that in liquidation this triggers the government backed Redundancy Payments Service (RPS) to pay out the staff the money they are owed. This fund covers redundancy, pay in lieu of notice, unpaid wages and unpaid holiday (subject to some statutory financial limits).
